What is Political Advertising?

Under Regulation (EU) 2024/900, "Political Advertising" is advertising which is liable and designed to influence the outcome of an election or referendum, voting behaviour or a legislative or regulatory process, at EU, national, regional or local level within the EU.

This includes both campaign advertising and issue-based advertising by political actors and other organisations seeking to influence elections, referendums, or legislative or regulatory processes.

Who needs to complete this form?

You must complete this form if you want to run Political Advertising with BMG entities in EU Member States.

It does not apply to campaigns running only in the United Kingdom or Norway.

What happens if I do not complete the form?

We cannot run the campaign.

My campaign will run in the Netherlands. Do I need to complete this form?

No. The advertising sector in the Netherlands has established politiekereclame.nl as the central platform where political advertisers complete and publish their legally required transparency declarations.

Why does BMG require transparency information?

We are legally required to collect and publish transparency information about Political Advertising carried by BMG entities in EU Member States.

What transparency information will you make available?

We make the following transparency information publicly available:

  • sponsor identity
  • funding information
  • total campaign spend
  • subject matter of the advert
  • campaign dates
  • whether personal data was used in planning

We require but do not publish personal contact details of the individual submitting the form.

Who can access this transparency information?

The transparency information is freely available on our website for the duration of the relevant Political Advertising campaign.

Information may also be requested by journalists, researchers and regulators, for purposes including reporting, research and oversight.

Do you retain records?

Yes. We retain transparency information for 7 years as required by Regulation (EU) 2024/900.

Who is responsible for the content of the Political Advertising?

The sponsor is responsible for the content of the Political Advertising, compliance with applicable election laws, and the accuracy of the transparency information provided to BMG.

Will BMG review the advert or information?

We check that required transparency information has been provided and may ask for clarification where needed.

We do not assess or approve the political message.

Do you verify the transparency information provided?

We rely on the information provided by the sponsor.

Can a campaign be refused or removed due to issues with transparency information?

Yes. We may refuse, delay or remove campaigns where:

  • required information is not provided,
  • information is unclear or inconsistent, or
  • there are legal or compliance concerns.
What if the transparency information changes?

The sponsor or their representative must notify BMG promptly. We may update the published information or review the campaign.

Can incorrect information be reported?

Yes. Concerns can be raised using the contact details in the transparency information or by contacting BMG directly.

Who should regulators contact?

Contact compliance@bauermedia.com and the request will be passed to the relevant market team.
